SEC Gets Data Go-Ahead In Brocade CEO Case

Law360 (June 11, 2007, 12:00 AM EDT) -- A judge has shot down a request by former Brocade Communication Inc. CEO Gregory Reyes to quash the U.S. Securities and Exchange Commission’s subpoenas of Merrill Lynch & Co. Inc. and Deutsche Bank AG.

Judge Charles R. Breyer refused to stop the SEC from seeking financial information from the two brokerage firms about accounts owned by Reyes, who is accused of improperly backdating stock options, in the U.S. District Court for the Northern District of California on Monday.
