High Court Sends Philip Morris Suit To State Court

Law360, New York (June 12, 2007, 12:00 AM EDT) -- The Supreme Court Tuesday unanimously struck down Philip Morris USA's attempt to remove a putative class action charging the tobacco company with unfair business practices under Arkansas state law to federal court and remanded the suit to state court.

In the opinion, penned by Associate Justice Stephen Breyer, the High Court reversed the rulings of both a district court and the Court of Appeals for the Eighth Circuit and held that Philip Morris could not rely on a federal statute that permits the removal of actions...
