US Must Pay $142M In Nuke Waste Contract Row: Fed. Circ.

Law360, New York (August 23, 2011, 3:53 PM EDT) -- The Federal Circuit on Tuesday upheld a $142.4 million award to Southern California Edison Co. over the U.S. government's failure to fulfill its nuclear waste removal contracts, finding that SCE was entitled to recover $23.7 million in overhead costs.

The U.S. Department of Energy appealed the overhead portion of the damages in October, claiming that the indirect overhead costs were part of SCE's overall overhead and were caused by operations totally independent from the breach of contract.
