GSK Drug Reps Ask High Court To Review OT Exemption

Law360, Washington (August 23, 2011, 6:13 PM EDT) -- GlaxoSmithKline PLC drug sales representatives found exempt from overtime pay laws want the U.S. Supreme Court to take up their Fair Labor Standards Act suit, claiming the Ninth Circuit created a circuit split by ruling against them.

In February, the Ninth Circuit affirmed the U.S. District Court for the District of Arizona's ruling that a proposed class of GSK sales representatives were not entitled to overtime pay, giving no deference to an amicus brief lodged by the U.S. Department of Labor.
