Judge Nixes Bids To Toss Heart Device Claims

Law360 (June 13, 2007, 12:00 AM EDT) -- In a blow to Boston Scientific Corp., a federal judge has denied several of the company’s motions to toss product liability claims over allegedly defective implantable heart defibrillators, allowing the cases to proceed to trial.

U.S. District Judge Donovan W. Frank on Tuesday issued the ruling in the case of plaintiff Leopoldo Duron, Jr., a 73-year-old California resident whose case against Guidant Corp., which Boston Scientific acquired last year, has been selected to be the first bellwether trial among the more than 1,600 product liability suits...
