Embarq Triumphs In Internet Privacy Action

Law360, New York (August 24, 2011, 3:25 PM EDT) -- A Kansas federal judge ruled Friday that a putative consumer class couldn't hold Embarq Management Co. liable under a federal privacy law for allowing online advertising company NebuAd Inc. to access customers' Web communications, granting the defendant summary judgment.

U.S. District Judge Julie A. Robinson said that the Internet service provider and affiliate United Telephone Co. of Eastern Kansas, which uses the Embarq brand name, didn't intercept or have access to the communications that now-defunct NebuAd culled to target consumers with advertisements, sinking the plaintiffs' claim...
