7th Circ. Nixes Unjust Profit Claims In Cigarette Ad Suit

Law360, Washington (August 25, 2011, 7:05 PM EDT) -- The Seventh Circuit on Thursday affirmed that a proposed class' unjust enrichment claims were invalid in an action claiming Lorillard Tobacco Co., Philip Morris USA Inc., R.J. Reynolds Tobacco Co. and several other tobacco companies engaged in deceptive marketing of cigarettes.

The proposed class action, which was first filed in 1998 in Illinois state court and later removed to federal court, accused the tobacco companies of unjustly profiting from misrepresentations about cigarette safety, but a district judge threw out the plaintiffs’ fourth amended complaint in June...
