9th Circ. Grounds New Runway Plans At Ore. Airport

Law360, New York (August 26, 2011, 11:29 AM EDT) -- The Ninth Circuit ruled Thursday that the Federal Aviation Administration must further study the environmental impact of a proposed runway at an Oregon airport, saying the agency failed to consider the possibility that airport traffic would increase when it approved the project.

In a published opinion, a three-judge panel ruled that the FAA had wrongly fast-tracked the Port of Portland's plans to construct a third runway at Hillsboro Airport, Oregon's busiest airport, about 12 miles outside of downtown Portland.
