High Court Shouldn't Revive Cellphone Emission Suit: US

Law360, New York (August 26, 2011, 9:51 PM EDT) -- The federal government argued Friday that the U.S. Supreme Court should not revive a putative class action accusing several cellphone providers of failing to shield users from allegedly hazardous radio frequency emissions because it would undermine federal regulatory responsibilities.

In an amicus brief requested by the Supreme Court, the government echoed rulings from a Pennsylvania federal court and the Third Circuit that the petitioner's claims against Nokia Corp., AT&T Wireless Services Inc. and more than a dozen other defendants were preempted by federal law.
