BP Oil Spill MDL Plaintiffs Can Seek Punitive Damages

Law360, New York (August 29, 2011, 12:16 PM EDT) -- The Louisiana federal judge in charge of the multidistrict litigation over the Deepwater Horizon oil spill ruled Friday that individuals and businesses claiming spill-related property destruction and economic loss could seek punitive damages from BP PLC and others.

U.S. District Judge Carl Barbier said that although the Oil Pollution Act is silent on the issue of punitive damages, the plaintiffs could still allege punitive damages under general maritime law.
