Construction Cos. Get Full Retrial On $90M FCA Judgment

Law360, New York (August 29, 2011, 4:03 PM EDT) -- A Washington federal judge ruled Monday that the retrial of a construction contractor originally hit with a $90 million judgment for alleged bid-rigging and fraud would proceed on all issues, rejecting the government’s calls to leave intact $30 million in damages.

U.S. District Judge Royce Lamberth said he was bound by an appeals court’s ruling to conduct a full retrial on the merits of the government’s case against Bill Harbert International Construction Inc. and its subsidiaries, Harbert International Inc. and Harbert Corp.
