FLSA Amendment Powers OT Win For Alpine Drivers

Law360, New York (August 29, 2011, 7:57 PM EDT) -- A New York federal judge on Monday ruled logistics company Alpine Logistics LLC must pay a class of truck drivers that sued for overtime compensation, finding a 2008 amendment to federal labor law made the drivers eligible for overtime benefits.

In his decision, U.S. District Judge Michael Telesca said the Michigan-based company inaccurately interpreted the effect of the Technical Corrections Act, which amended the Fair Labor Standards Act, in its refusal to pay its drivers overtime hours.
