Costco LCD Price-Fixing Suit Survives Dismissal Bid

Law360, New York (August 29, 2011, 6:31 PM EDT) -- Costco Wholesale Corp.'s complaint against LG Electronics Inc. and others in the multidistrict litigation over alleged price-fixing in the liquid crystal display panel industry mostly survived a motion to dismiss Monday in California federal court.

U.S. District Judge Susan Illston granted the defendants' motion to dismiss Costco's claims under the antitrust laws of some states but rejected their contention that the complaint is too ambiguous and fails to provide an adequate description of each defendant's involvement in the alleged price-fixing conspiracy.
