Applebee's Owner Asks To Nix Class In Tipping Row

Law360, New York (August 30, 2011, 7:26 PM EDT) -- The owner of more than 30 Applebee's restaurants in Illinois asked a federal judge on Monday to decertify a class of former tipped employees who allege the chain improperly tabulated their pay, staking its argument on a U.S. Supreme Court victory for Wal-Mart Stores Inc.

Applebee's International Inc. franchisee Appleillinois LLC is seeking to decertify one of three classes of workers including former servers, bartenders and hosts at 38 Chicago-area restaurants who were granted certification in a March order.
