US Denied Retrial Against Research Co. In $5M FCA Suit

Law360, New York (August 30, 2011, 5:07 PM EDT) -- The U.S. was refused a new trial on Monday in its case against an Arizona research company that allegedly made false statements in order to secure $5 million in funding from NASA and the U.S. Department of Energy.

A federal jury found in February that the Materials and Electrochemical Research Corp. had not violated the False Claims Act. The federal government demanded that the verdict be thrown out, saying it contradicts the evidence in the case in a motion filed in March.
