Eisai Patent Win Pains Antitrust Claimants

Law360 (June 14, 2007, 12:00 AM EDT) -- Direct purchasers of ulcer medicine Aciphex dismissed their class action antitrust lawsuit against Eisai Co. Ltd. on Wednesday following the Japanese pharmaceutical company's victory in a patent infringement case which essentially quashed the antitrust claims as well.

Meijer Inc., Rochester Drug Cooperative Inc., SAJ Distributors Inc. and Stephen L. LaFrance Holdings Inc. voluntarily dismissed their consolidated lawsuit accusing Eisai of preventing a generic version of its lucrative ulcer drug Aciphex from hitting the market by duping patent examiners.
