Junk Faxing Atty Hit With $4.2M Class Judgment

Law360, New York (August 31, 2011, 7:43 PM EDT) -- An Illinois federal judge awarded $4.2 million on Monday to a class of unwilling fax recipients who accused an estate planning attorney of sending them a purported newsletter that essentially functioned as an unsolicited advertisement.

U.S. District Judge Robert W. Gettleman granted summary judgment to named plaintiff Ira Holtzman CPA & Associates Ltd. as to the only factual question remaining in the Telephone Consumer Protection Act suit against Skokie, Ill., lawyer Gregory P. Turza: the number of faxes successfully sent to the class.
