Westfield, Rouse Must Hand Over Atty Advice: Court

Law360, Chicago (September 1, 2011, 4:31 PM EDT) -- An Illinois appeals court ruled Tuesday that shopping mall operators Westfield America Inc. and Rouse-Urban LLC must hand over certain attorney-client communications in a breach of contract suit they face from industry rivals over a 2002 asset purchase deal.

The appeals panel held that because defendants Westfield, Rouse and their related entities disclosed to one another certain conversations they'd had with their attorneys while they negotiated the purchase agreement, they had waived privilege on both disclosed and nondisclosed attorney-client communications about the deal.
