Judge Keeps 'Material Girl' Trademark Suit In Play

Law360, New York (September 2, 2011, 3:56 PM EDT) -- A California federal judge on Wednesday refused to toss a suit accusing Madonna’s Material Girl Brand LLC clothing line of infringing another apparel company's trademark for the singer's famed nickname.

U.S. District Judge S. James Otero shot down the defendants’ arguments for summary judgment, ruling it would have been inappropriate in light of the genuine issues of fact in dispute between the allegations of L.A. Triumph Inc. and defendants Material Girl, MG Icon and Macy's Retail Holdings Inc.
