FAA Pushes Early Resolution In Contract, Bid Disputes

Law360, New York (September 7, 2011, 5:37 PM EDT) -- The Federal Aviation Administration on Wednesday finalized a rule that will push more conflicts into mediation and arbitration, limit motions and appeals, and toughen sanctions for parties that break the rules.

The rule, drafted in January, emphasizes early dispute resolution and makes alternative dispute resolution — like mediation, arbitration and neutral case evaluation — the first stop in any contract dispute. The rule marks the first major changes since a 1999 overhaul, which established alternative options like mediation and created the agency's Office of Dispute Resolutions for Acquisition....
