Ch. 11 Trustee Can't Merge Film Producer's Cos.

Law360, New York (September 8, 2011, 7:33 PM EDT) -- A California bankruptcy judge refused Tuesday to consolidate the bankruptcy cases for film producer David Bergstein’s various businesses and to lump in nondebtor affiliates despite claims from the Chapter 11 trustee that Bergstein’s empire is a “shell game.”

U.S. Bankruptcy Judge Barry Russell rejected the trustee Ronald Durkin’s bid to substantively consolidate the five bankruptcy cases and 12 nondebtor companies, finding little reason to give the trustee sweeping control over the debtors as well as unencumbered affiliates, according to Jeffrey Garfinkle, an attorney for Bergstein’s former...
