SanDisk Wins Right To Appeal In Ritz Antitrust Row

Law360, New York (September 8, 2011, 12:00 PM EDT) -- A California federal judge gave SanDisk Corp. permission Wednesday to appeal his refusal to dismiss a proposed class action alleging the company used false patents and sham litigation to maintain a monopoly on flash memory.

U.S. District Judge Jeremy Fogel granted SanDisk permission to pursue the interlocutory appeal and stayed discovery in the suit brought by Ritz Camera & Image LLC. He said the cost of conducting potentially unnecessary discovery warranted the delay.
