Evanston Avoids Coverage For Chinese Drywall MDL

Law360, New York (September 9, 2011, 7:24 PM EDT) -- A Virginia federal judge ruled Friday that Evanston Insurance Co. does not have to cover claims brought against a homebuilder in multidistrict litigation over defective Chinese drywall because they are barred by pollution exclusions in the homebuilder's policies.

Jackson granted a summary judgment motion from Evanston, handing the insurer victory in its declaratory judgment suit against policyholder Harbor Walk Development LLC, its contractors and the homeowners who brought three underlying suits against Harbor Walk and others for property damage and injuries...
