San Juan Phone Class Gets Hung Up On Atty Conflict

Law360, New York (September 12, 2011, 2:03 PM EDT) -- Finding that the plaintiffs’ attorney may have a conflict of interest, a Puerto Rico federal judge on Friday recommended the denial of class certification for customers claiming the head of Phoneworks Inc. exploited connections to the mayor of San Juan to secure public telephone contracts.

The plaintiffs’ attorney, Lorenzo J. Palomares-Starbuck can not adequately perform his duties as counsel for the class since he also represents other parties in the suit against Phoneworks, according to a report and recommendation from U.S. Magistrate Judge Bruce J. McGiverin....
