Becton Dickinson Sued Over Syringe Patents

Law360, New York (June 18, 2007, 12:00 AM EDT) -- Retractable Technologies Inc. has filed a lawsuit against Becton Dickinson and Co. accusing the medical technology giant of patent infringement, false advertising and anti-competitive conduct.

The new lawsuit comes as Becton faces consolidated antitrust litigation in New Jersey over its alleged abuse of dominant position in the hypodermic products market.

Retractable filed its complaint Friday in a Texas district court, claiming that Becton infringed three patents covering Retractable's safety syringes. Retractable also alleged that Becton falsely advertised its non-infringing syringes as “safe” or “safety-engineered” in order...
