$61M Air Force Contract Bidder's Claims Nixed In IP Suit

Law360, New York (September 13, 2011, 6:07 PM EDT) -- A Montana federal judge on Tuesday tossed Precision Lift Inc.'s counterclaims in Flexible Lifeline Systems Inc.'s suit alleging Precision illegally used an IP portfolio sold in an asset purchase agreement in its bid for a $61 million U.S. Air Force contract.

Flexible had moved for summary judgment on Precision's claims of tortious interference and breach of an implied covenant of good faith and fair dealing, while Precision asked for summary judgment on Flexible's copyright, Lanham Act and trade secret misappropriation claims.
