Advertiser Can't Shake Facebook's Spam Suit

Law360, New York (September 14, 2011, 10:40 PM EDT) -- A California federal judge on Wednesday refused to toss Facebook Inc.'s suit against online advertiser MaxBounty Inc. over an allegedly misleading marketing scheme the social media giant says violated its policies and federal law.

U.S. District Judge Jeremy Fogel denied MaxBounty's request to dismiss Facebook's claims of fraud and violations of the Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM) and the Computer Fraud and Abuse Act, saying Facebook had stated enough specific facts to adequately plead the claims.
