2nd Circ. Nixes Costco Shrimp Skimp Suit

Law360, New York (September 20, 2011, 3:37 PM EDT) -- The Second Circuit dealt another blow Tuesday to a father and son's crusade against Costco Wholesale Corp. over the size of its shrimp trays, ruling that a lower court was right to dismiss their proposed class action.

In a three-page summary order, a three-judge panel found that U.S. District Judge Colleen McMahon was right to throw out Marc and Robert Verzani's case, and to deny their motion to file an amended complaint.
