BCI Aircraft CEO's Bid To Squelch Evidence Rebuffed

Law360, New York (September 21, 2011, 2:39 PM EDT) -- An Illinois federal judge on Tuesday closed the door on an effort by BCI Aircraft Leasing Inc.'s CEO to toss out evidence gained from a search warrant in a criminal case accusing him of helping to rig a $50 million investment scheme.

U.S. District Judge Amy J. St. Eve denied Brian Hollnagel's request under U.S. Supreme Court 1978 precedent in Franks v. Delaware for a hearing over the legitimacy of the warrant used to obtain the information. In such hearings, parties can explore whether search warrants were issued...
