11th Circ. Vacates $150M Verdict In Road Contract Row

Law360, New York (September 20, 2011, 7:03 PM EDT) -- The Eleventh Circuit vacated a $150 million verdict Tuesday against materials tester Applied Technical Services Inc. in Douglas Asphalt Co.'s suit over ATS' allegedly faulty finding that the company had botched roadwork under a contract with the state of Georgia.

A three-judge panel affirmed a lower court's turning aside of some of the claims brought by the plaintiff and reversed its rejection of ATS' bid for judgment as a matter of law as to the other claims, remanding the case to the lower court for entry...
