Ex-Shoe Show Manager Denied Class Cert. In OT Suit

Law360, New York (September 21, 2011, 5:22 PM EDT) -- A federal judge in Illinois on Monday rejected an ex-Shoe Show Inc. employee's bid for conditional certification of a class of hundreds of store managers who were allegedly misclassified as overtime exempt.

U.S. District Judge J. Phil Gilbert denied named plaintiff Colleen Drew's motion for collective action certification, saying she had fallen short of the “modest factual showing” necessary to warrant notice-stage certification on her claim for overtime pay under the Fair Labor Standards Act.
