Care 1st Faces Patient's Suit Over Lost Data

Law360, New York (September 23, 2011, 2:32 PM EDT) -- A Care 1st Health Plan member launched a proposed class action in California state court Wednesday accusing the managed care organization of failing to encrypt members' private medical information on a computer disk that was misplaced.

The California Department of Health Care Services, a nonparty in the suit, lost a computer disk containing Care 1st members' names, addresses, Social Security numbers, birth dates, genders and coverage plans, according to a complaint filed by Beatrice Yanez.
