Gaspari Nears $1M Deal Over Supplement Marketing Claims

Law360, Los Angeles (September 26, 2011, 8:16 PM EDT) -- A California federal judge on Monday tentatively approved a $1 million settlement between Gaspari Nutrition Inc. and a consumer class accusing the company of marketing bodybuilding supplement Novedex XT as containing only dietary supplements even though it contained a purportedly dangerous nondietary ingredient.

U.S. District Judge Gary A. Feess said the deal, which would reimburse the thousands of consumers who have purchased Novedex XT, was fair and reasonable, but waited to grant preliminary approval of the deal until after attorneys had submitted a standardized opt-out form...
