Calif. Appeals Court Nixes $8.6M Fox Financing Suit

Law360, New York (September 26, 2011, 11:09 PM EDT) -- A California appeals court on Monday affirmed the dismissal of Smashing Pictures LLC's suit alleging Twentieth Century Fox Film Corp. breached a co-financing contract and failed to return Smashing's $8.6 million investment.

A three-judge panel for the California Court of Appeal, Second Appellate District, agreed with a trial court's ruling that an amendment to the agreement clearly states that Fox could reallocate the investment if Smashing failed to deliver the full agreed-upon $25 million amount.
