Judge Tosses Don, Doff Action Against Alcoa

Law360, New York (September 28, 2011, 6:30 PM EDT) -- A New York federal judge on Wednesday threw out an employment class action against aluminum producer Alcoa Inc., saying the employees could not prove donning and doffing mandatory safety gear was indispensable to their jobs.

U.S. Magistrate Judge George H. Lowe granted Alcoa’s motion for summary judgment in a case brought by more than 200 former employees of the company’s Massena West plant, saying the plaintiffs failed to show there were triable issues of fact in dispute.
