NY Waiters Get Class Certification In FLSA Suit

Law360, New York (June 21, 2007, 12:00 AM EDT) -- Almost 200 current and former waiters at a famous New York restaurant were served a small victory on Monday, after a federal judge granted them class certification in an ongoing FLSA suit against Spark's Steak House.

The suit, first filed in the Southern District Court of New York last year, sought to recover unpaid minimum wage and unlawfully expropriated tips covered under the Fair Labor Standards Act and New York labor law.
