Ex-Aeropostale Exec Tries Again To Bury Kickback Charges

Law360, New York (October 4, 2011, 6:00 PM EDT) -- A former Aeropostale Inc. executive on Monday made another attempt to evade criminal charges in New York alleging he received kickbacks in exchange for multimillion-dollar business deals with a clothing manufacturer, claiming prosecutors failed to say how Aeropostale was harmed.

In their quest to dismiss 16 charges in a 17-count indictment, ex-Chief Merchandising Officer Christopher Finazzo and clothing distributor South Bay Apparel Inc.'s chief executive Douglas Dey contend that prosecutors never actually alleged that they misrepresented their financial relationship to Aeropostale.
