EBay Tries To Boot Sellers' Antitrust Suit Over PayPal

Law360, New York (October 5, 2011, 9:39 PM EDT) -- Online auction giant eBay Corp. on Tuesday asked a California federal court to toss a proposed antitrust class action alleging the auctioneer illegally tied auction sales to online payments processed by eBay's PayPal Corp., arguing the suit was time-barred.

In a motion to dismiss the case, both eBay and PayPal contend a four-year statute of limitations on Sherman Act claims bars the class from bringing the case. EBay acquired PayPal for $1.5 billion in October 2002.
