Citing Concepcion, Judge Lets Robert Half Arbitrate OT Row

Law360, New York (October 7, 2011, 9:15 PM EDT) -- A New Jersey federal judge on Thursday sent to arbitration a proposed overtime class action against Robert Half International Inc., finding the staffing agency could arbitrate the case in light of a recent U.S. Supreme Court decision.

U.S. District Judge Faith S. Hochberg granted Robert Half’s motion to compel arbitration and dismiss the case, ruling the high court's April decision in AT&T Mobility LLC v. Concepcion — which found that arbitration contracts can ban class actions — applied to the Fair Labor Standards Act case. ...
