Australian High Court Denies 'Down Under' IP Appeal

Law360, New York (October 7, 2011, 1:44 PM EDT) -- The record label for the band Men at Work has reportedly lost its last bid to appeal a ruling that the band's 1981 hit "Down Under" infringed the copyright on the 1930s children's song "Kookaburra Sits in the Old Gum Tree."

The Associated Press reported that the High Court of Australia denied an appeal by EMI Music Publishing Australia Pty Ltd. of a lower court's ruling in favor of Larrikin Music Publishing Pty Ltd., which holds the copyright on "Kookaburra" and sued EMI in 2008....
