Date Check App Defamation Class Action Rejected

Law360, Los Angeles (October 7, 2011, 4:49 PM EDT) -- A California judge on Friday threw out a putative class action alleging Intelius Inc., maker of the Date Check smartphone application, defamed people across the country and violated a state consumer protection law by returning false reports of criminal histories.

Judge Kevin C. Brazile granted the software developer’s motion for demurrer, ruling that Intelius was protected by the federal Communications Decency Act, which immunizes Internet republishers from defamation liability.
