Ex-Costco Managers' Class Cert. Bid Denied In OT Suit

Law360, New York (October 12, 2011, 1:37 PM EDT) -- A federal judge in California on Tuesday rejected a motion for class certification from three former receiving managers who sued Costco Wholesale Corp. claiming that the company misclassified them as exempt from the state's overtime pay requirements.

U.S. District Judge James V. Selna declined to certify a proposed class that would have consisted of current and former receiving managers employed by Costco in California since April 4, 2007, concluding that individual issues predominated over common issues.
