Edison Plant Gets US' Pollution Suit Booted

Law360, New York (October 12, 2011, 9:10 PM EDT) -- A Pennsylvania federal judge on Wednesday threw out a pollution case brought by the federal government and several states against an Edison Mission Energy-operated power plant, finding the government's claims were brought well beyond the applicable statute of limitations.

In dismissing the case with prejudice, U.S. District Judge Terrence McVerry rejected to allegations by the federal government, as well as intervenors New York, New Jersey and Pennsylvania, that EME Homer City Generation LP's Indiana County coal-fired power plant was operating without proper permits.
