EU Court Casts Doubt On Cosmetics Co.'s Online Sales Ban

Law360, New York (October 13, 2011, 3:45 PM EDT) -- French cosmetics company Pierre Fabre Dermo-Cosmetique SAS' refusal to let its distributors sell its products online likely violates European Union antitrust law, the EU's highest court ruled Thursday.

The European Court of Justice concluded that the ban was not protected by the EU's block exemption for vertical agreements, but said that under certain conditions the Pierre Fabre contracts might qualify for an individual exemption from the bloc's antitrust law.
