Supreme Court Will Hear Regulatory Preemption Case

Law360 (June 26, 2007, 12:00 AM EDT) -- The Supreme Court has agreed to hear a potentially landmark case that could clarify whether compliance with federal regulations shields companies from state product-liability laws, particularly in the realm of medical devices.

The Supreme Court granted a writ of certiorari to Charles R. Riegel et ux. v. Medtronic Inc. on Monday. Medtronic argues that it is immune from state product-liability laws or actions regarding its allegedly faulty coronary catheter because the catheter received approval from the Food and Drug Administration and complies with the FDA's guidelines....
