Funk Label Loses Copyright Fight Over Song Downloads

Law360, New York (October 18, 2011, 6:19 PM EDT) -- A New York federal judge on Tuesday threw out a suit by record label TufAmerica Inc. accusing music distributor The Orchard Enterprises Inc. of failing to pay royalties in violation of a licensing agreement, ruling that Tuf failed to state a facially plausible claim.

U.S. District Judge Shira A. Scheindlin granted Orchard's motion to dismiss copyright infringement claims, and further ordered the last remaining claim for unjust enrichment dismissed without prejudice for lack of subject matter jurisdiction.
