IBM Beats IT Worker’s Class Cert. Bid In OT Suit

Law360, New York (October 20, 2011, 2:08 PM EDT) -- IBM Corp. on Wednesday defeated an information technology specialist's bid to certify a class to bring claims that the computing giant misclassified its workers as exempt from overtime pay requirements and otherwise violated California's labor laws.

U.S. District Judge Cormac J. Carney granted IBM's motion to deny class certification on Roberto Silva's state law claims, finding that Silva had conceded certification for the classes proposed in his first amended complaint would be inappropriate and that the plaintiff had failed to show the company's motion was premature...
