Wyeth Sued Again Over Effexor Generics Delays

Law360, New York (October 20, 2011, 5:29 PM EDT) -- A New Jersey employee retirement fund on Tuesday became the latest group to lodge a putative class action against Pfizer Inc. unit Wyeth LLC accusing the drugmaker of engaging in anti-competitive behavior in order to gain a monopoly on antidepressant Effexor XR.

The suit, brought by the Southern New Jersey Regional Employee Benefits Fund in New Jersey federal court, claims Wyeth illegally maintained monopoly power for two years by fraudulently obtaining three patents for extended-release formulas of the drug, known as venlafaxine hydrochloride, and engaged in...
