Calif. Court Sends Forever 21 OT Suit To Arbitration

Law360, New York (October 21, 2011, 5:55 PM EDT) -- A proposed overtime class action against clothing retailer Forever 21 Inc. was sent to arbitration Thursday by a California appeals court, which reversed a lower court's decision to let the case proceed in court.

While Judge John P. Shook of California Superior Court in Los Angeles County ruled that an arbitration agreement signed by the plaintiffs was unconscionable, the appeals court found that he misconstrued the agreement.

The appeals court reversed Judge Shook's ruling and ordered that Forever 21's motion to compel arbitration be granted....
