Law360, New York ( October 25, 2011, 12:26 PM EDT) -- Seeking to enhance the integrity of size representations, the Small Business Administration recently proposed that the measure of damages to the government for a concern that willfully misrepresents its size to gain a contract or subcontract is the total amount expended by the government. The SBA proposed this regulation on Oct. 7, 2011 (76 Fed. Reg. 62313-21) to implement provisions of the Small Business Jobs Act of 2011.
